Terms and conditions
Benches will be of the type and colour specified by us to be in keeping with the intended location. This will allow for uniformity and ensure that the memorial does not detract from its surroundings.
All benches will be installed by us or approved contractors, ensuring liability for faulty installation or subsequent issues arising will remain with us. We will attempt to accommodate your wishes wherever possible. If a location at a requested site cannot be accommodated, we may provide you with an alternative site/location if available.
In the event that the first-choice area for a bench is unavailable, officers will work through their choices. If no sites are available, you may be placed on a waiting list and notified when a site of choice becomes available. This ensures no one area is oversaturated with benches whilst offering you every chance to gain a memorial.
You will be responsible for keeping your contact details up to date and responses must arrive within the required timeframes. The demand for memorials and the spirit of equity will direct our actions with regards to late responses. However, we reserve the rights laid out in the terms and conditions.
We accept no liability for damage to memorials from vandals, third parties or whilst we carry out routine maintenance. We will notify you if the memorial bench is damaged beyond what we deem a small repair. The cost of repair will be the responsibility of you and will be repaired by our approved contractors only. If after 4 weeks, payment for the repair has not been made, we will either remove or fix the bench at their own expense and your lease will be terminated with no refunds.
We reserve the right to remove any memorial benches surveyed by appointed inspectors that have been damaged beyond economical repair, deemed unsafe, or has no plans for repair in place after four weeks of the notification referred to above. You must ensure no other type of memorial will be displayed on or around the agreed memorial including flowers, ornaments, toys, balloons etc. Such memorial will be removed and disposed of immediately as stated in the Terms and Conditions.
Memorial plaques will be of a size to fit the specific furniture to ensure an easy fit in the centre of the upper most lath of the front or back of the bench. Plaque inscriptions should be provided with the application. Inscription length is limited, and content is subject to the approval of us to ensure that it is appropriate/non offensive. Once approved the plaque will be purchased by you at your own cost.
The cost of replacement benches or plaques during the term of the agreement will be your responsibility. Maintenance will include simple low grade repairs, and scheduled painting will be at the our discretion. The charge will also cover periodic inspections of the bench. This does not include cleaning. Benches will be cleaned at the our discretion.
Whist being a personal memorial, it should be clear that the rights and benefit of the memorial will be for the public as a whole, with no individual rights taking precedence. The asset itself will be owned by us. We will limit the number of memorial benches in a particular area so that they shall not detract from the principal purpose of the site.
Should you wish to paint the bench yourself, you must gain agreement from us prior to undertaking any work, by emailing serviceliaisonteam@cheshirewestandchester.gov.uk. We will specify the colour and brand of materials used, in keeping with the environment, and will advise on any necessary procedures, such as signage etc. Failure to comply may result in the removal of the bench and termination of the agreement without recompense.
